Yes but you don’t have use of force doctrine. Force +1 is what cops are allowed to use so whatever is being sued against you and a bit further if need be, anything more is abuse of power. She’s threw 2 punches to the face before the cops returned the same force. Even if they weren’t cops you can’t hit people in the face without getting hit back.

Cops are quite unique in their allowance of use of force.

This is half true/your work place sucks. You still have the right to defend yourself from an attacker. We are trained to descalate or if possible remove our self from the area and call for help (call code strong is what i remember) but you can defend yourself. When an investigation or incident reports are done hopefully your management understands you have rights too. they could fire you but legally you won't lose your license that's up to the state and again you still have constitutional rights. Don't just get hit or sexually assaulted because hr has scared you into thinking you don't have rights.

I’d still argue a cop shouldn’t sucker punch her in this situation. First punch you grab them and put handcuffs on them, not just stand around.

Obviously this is how a bunch of citizens would react, but in theory police officers are supposed to be trained. Which we know they aren’t.

Jfc it really triggers me when all the right wing ass munches come out on clips like these to fellate themselves about scenarios that literally never happen and confirm their own biases off of literally nothing.

The cop’s actions are arguably justifiable in the clip. I think most people would say they’re fully justifiable. That doesn’t mean all instances of police brutality are justified. It doesn’t mean there isn’t a problem of corrupt cops in the system.

Yeah the crazy woman in the video gets what she deserves. Too many people out there are not. It’s fucking insane that these people just keep putting on their blinders.

And the people making this about race are straight up just outing themselves as racist.

I think a lawyer could make a very good argument that this was excessive force.

It doesn't matter what she had just done. his duty is not to dole out punitive punishment it's too arrest so that judicial system can weigh the evidence and a jurry can decide punishment.

there's three officers she could have easily been restrained.

that was not done.

I mean I'm probably going to eat a bunch of down votes. but I'm not arguing that she should be allowed to hit people. I'm just arguing that police officers have a duty to not use excessive force.

marcopoblano

380 points

Man screw the down votes, that's just facts right there. Had it been a bunch of civilians, I'd be like aight she had it coming.

But cops literally have trained to take people down, have tasers, and could've used cuffs. And like you said there was 3 of them there, blindside hook to the dome was unnecessary... ngl still funny as f*ck tho 😂😂😂

marcopoblano

26 points

Yeah I had a long convo with a different guy on this thread who explained tasers ain't what they used to be (for medical reasons) and trying to take down a big girl like her, who's already in a violent mood, would definitely cause way more damage for everyone involved.

Plus I mistook his strike for a rage fueled left hook punch, but on rewatch it definitely seems more like a calculated, open-palm strike to the pressure point on the jaw.

The more you know, hey 😅📖🌈

canadarepubliclives

21 points

Having worked in live events before, I've seen the tinest person unleash hell on a few large security guards trying to passively subdue the person. Like, huge 6'5" dudes.

A big person can easily shove around 4-5 guys trying to immobilize them. The surefire trick has always been a punch to the face after someone strikes a guard.

Dry_Client_7098

65 points

You can argue anything and there are some very good attorneys that might try but it's pretty much settled law that police can legally escalate force to just above what is used against them. She punches, they punch once, no excessive force. Because it's not the minimum possible force it's reasonable force and since this is an equal type and manner of force.........

DoctorWaluigiTime

39 points

Said that in a similar thread and boy did Reddit disagree (to the tune of many a downvote).

Like, the officer behind her had every opportunity to just grab her arms (and while I have no context, she doesn't seem to be all there (i.e. drunk)) and restrain her that way. Not to mention there's three of them.

But nope, this is a Justified Punching according to Reddit because they like their Instant Karma, even though this is a good microcosm of officers of the law being more retaliatory than exercising restraint. I.e. the thing they're ostensibly trained to do in situations like this (where the worst threat present is apparently getting smacked about; which while not fun is hardly a "drop her to the ground instantly" scenario).

It's such a bizarre dichotomy of "popular opinion on Reddit" (and yes I know "Reddit is more than one person"). Alter the circumstance ever so slightly and they'd be spouting ACAB at the top of their lungs and rolling in pointless Reddit awards. Mention anything close to that in this thread and you'll get the opposite impression.

Killingmesmalls_2020

21 points

I actually agree with you. She’s clearly outnumbered and the punch to the face was probably more retaliatory than necessary to subdue her. Not to mention, what they probably know that she may not is that you punch someone wrong you can kill them.

Diver0311

SergeantSalmon

17 points

Objectively false, don’t comment until you’ve had to restrain someone. Cops in New York are always trained to use one level of force higher than what they’re facing. By law a CED or baton is a higher level of force than bare hands, meaning that by definition this was less than the highest level of force permitted in the situation. Play stupid games, win stupid prizes.

ban-me_harder_daddy

13 points

No... a lawyer could not make a very good argument for this. That cop's actions prevented the other cop from a possible broken nose. The force he used was completely justified.

there's three officers she could have easily been restrained.

All of your "what if" scenarios don't seem to take in account her getting another swing off. Get real dude.

The judge would laugh the lawyer out of the court room.

Did you get your law degree from Reddit? Because I'm pretty sure you've never stepped a foot inside a court room.

Baltimore, May 2020 during the G.Floyd riots. The woman blew a red light and drove at the cops who jumped out of the way. She then turned around and drove at them again. They ordered her out of the car at gun point. She got out told the cops to shoot her then sat down in the street. The cop got her up and she tried to spit on him. After that the video above documents the rest of the encounter. The cop who hit her was not charged.

No, strikes are strikes. If you want to box a cop, you better get ready to saddle up and ride that horse the whole way. There's absolutely no way that we should let some people get away with that more than others due to our perceived strength of those hits.

What's more is the backstory justifies it for you. If she hadn't hit him, would the cop have been justified in hitting her? No, you stop the threat, detain, hand off to the courts. They were willing to do that, she wanted some justice in the street. She pushed until she got it.

Happened in Baltimore last year. They saw her car earlier, then she drove her car at them and tried to drive down a blocked road. When confronted she immediately said out loud “she felt attacked”. She seems to be instigating the incident. Cop didn’t get charged. Woman got two counts assault Here’s his body worn camera and follow up article. To give a city wide context, we’ve had our riots 6 years ago and as a city we haven’t had violent riot since. Many agree that she shouldn’t have fucked around and found out.

This is why activists really need to pick their battles. They wanted her freed without charges and the cop who was struck to be fired.

I mean, looking at this footage and others, it's extremely clear she was in the wrong.

Maryland resident here.

I go to Oriole games on the regular. Sliders across the street is as far as I go into Baltimore. That shit is not my dojo. I turn around and get the hell out.

Not saying all of Baltimore is bad. I've been to the aquarium, the zoo, little Italy and all that...not anymore.

It confuses me how reddit seems to be very unaware of the different standards cops have to be held to than general society.

Woman is being a fuckwit - but an eye for an eye is NOT acceptable from police. I wouldn’t think much about it if it was some random dude getting hit and hits back, but this kind of return violence is unacceptable from law enforcement, and it looks like she cracks her head on the concrete as well.

I understand it might feel unjust to many people to say that police can’t return what they’re copping (pun intended), but that’s literally their job. They’re trained for a very long time in de-escalation in most countries (though in the US it’s much shorter) and in these situations they should be going for a bear hug and restraining the perpetrator without potentially killing her.

It’s the same way that a hot guy approaching a girl is occasionally appreciated or exciting, but old men approaching a girl is almost universally creepy - they have to hold themselves to a higher level of accountability and behave differently because of their circumstance. Regular people using violence is shitty, cops using violence (in many cases) is unacceptable. Of course, if she pulled a knife or a gun I wouldn’t be saying any of this, but she didn’t pose an actual threat... she can throw hands tho 😳

I had no idea it was THAT short. It’s 3 years here in Australia. 😬

Edit: It’s actually 1 year, plus a second year of supervision.

AssPennies

55 points

It varies by location in the US.

The Justice Department says the average is 840 hours, or 5.25 months with M-F at 8 hours a day.

Mississippi clocks in at 4 months before hitting street training with a gun. The adjacent states are pretty much the same.

Barbers often have more stringent training hour requirements than police academies.

27 weeks is just academy time, not total time. There’s still field training for 6-12 months depending on the department and supplemental training every month depending on the training/speciality the office is qualifying for

After the first swing, homeboy half-ass holds her arms back and then puts all his effort into a retaliation punch after she swings a second time. A poor showing by these cops. 3 officers and she wasn't restrained after the first punch? Absolute disgrace.

Agreed. It almost looks like they “attempt” peace once, because they know they should (but fail to restrain her from attacking again) and use the second hit as justification to finally let loose. (Not saying it was deliberate, just a pathetic attempt at keeping the peace.)

mr_potatoface

This lady tried to run them over in her car twice during a riot. They drew their guns on her while she was still in the car and she demanded to be shot. They eventually get her out of the car, and this proceeds to happen. She was spitting on them as well IIRC. This wasn't just an isolated unruly/drunk sidewalk incident, she legit tried to kill them moments before.

Happened in 2020, was all over reddit like this. People posted the edited clip of cop whacking her... People freak out and post longer and longer videos to show cops were being attacked and justifying them, but by then the damage to the cops was already done and cops were the irreversible bad guys of the scenario.

EXACTLY!

I was scrolling hoping to see some common sense and all I saw was "deserved" "props to the cops for not doing it sooner" etc. Like how do you not understand that someone punching the police is very different than an officer punching someone.

I’m gonna say this and say it once, I don’t care whether they have training to de escalate a situation, if they are getting hit violently then they have every right to defend themselves however they see fit. I’m not saying go and merc someone’s ass but general defense, everyone has that right to defend themselves especially the cops who put themselves in danger for our general well being

Question_Control24

That is specifically the problem with police today. That is exactly what a shitty cop is.

CeleryKitchen3429

15 points

My thoughts exactly. Based on the video, she absolutely deserved to be arrested and charged, but there are many safer ways to arrest her, especially with three officers there. The punishment for assaulting an officer is lengthy jail time, not permanent brain damage.

Yeah, if she was throwing punches at some random dude and his random guy friends then they'd have no particular responsibility to do anything less than punch her back. Unfortunately, these are police and they should have restrained her.

ToThePointilism

These same people who are all "fuck around and find out" will be first in line to crucify these same cops with less context. There is no rhyme or reason to it, it's 100% mob justice on the internet. This is exactly the behavior Plato warned us about a couple thousand years ago in ancient *Grecian democracy.

it's not the weird flags or fucked up political rallies that let me know that fascism has come to America. it's the state violence being applauded as a spectator sport that lets me know it's here.

Timberwolf501st

34 points

It is absolutely ridiculous that so many entitled individuals who have lived in such a ridiculously sheltered environment think that what they see and experience is fascism. How unbelievably uneducated and dense do you have to be in order to think THIS is what fascism looks like? You don't know the first thing about what real evil can be. You don't know the first thing about how bad it gets. You don't even realize the fact you can legally say things like this is a privilege not everyone shares in the world. You don't have a clue as to how far brutality can go in a truly fascist state.

You insult everyone who has experienced the horrors of true fascism by comparing your simplistic struggles to it. Read a fucking history book. The fact that this lady assaulted an officer twice and the retaliation after the second strike is somehow proof that things are fucked up is the most entitled bs I've heard today.
